Some of the most complex and challenging cases arise in defending
professionals. Often, they are sensitive cases which must be handled
carefully and aggressively.
Professional liability cases attack the insured's competence and,
often, personal integrity. The client feels the personal impact of
these cases. In today's litigious society, professionals are often a
"target defendant". Potentially large verdicts are at stake --
or, at least, the plaintiff's attorney believes there is a large verdict
potential. We have been involved in many cases of alleged professional
malpractice, including physicians, dentists, oral surgeons, architects,
engineers, insurance agents, attorneys, surveyors, appraisers, etc.
Special effort is needed to keep the client and insurer informed,
evaluate liability, locate the right experts with appropriate expertise
and rapport with the jury and in evaluating the case based on the law,
facts and damages.
We have successfully defended the overwhelming majority of
malpractice cases that went to trial including some unique claims,
e.g., lost chance of survival and failure to diagnose cancer.
